    Brief

    This is a notice of the suspension of the procurement procedure for grenades and 40 mm ammunition intended for use by the police and the Border Guard. The procurement includes various types of grenades designed for police and military use, such as flashbangs and smoke grenades, as well as different types of 40 mm ammunition. The specific requirements for the procurement will be clarified during the negotiation and bidding phases of the procurement process. The procurement will be conducted as a total procurement, meaning that the supplier must be prepared to offer all products included in the procurement. According to Section 75 of the Public Procurement Act, the contracting authority may suspend the procurement for a valid and justified reason. According to Section 22 of the Public Procurement Act, there must be a sufficient number of suppliers in the final phase of the negotiation process to ensure real competition, provided that there are enough compliant suppliers or bids. According to the government proposal to the Parliament regarding the law on public defense and security procurements and related laws (HE 76/2011), paragraph 3 states that in the final phase of the negotiation process, the contracting authority should strive to maintain a sufficient level of competition. A sufficient number of suppliers should be involved in the negotiations to ensure a genuine competitive situation. However, negotiations can only be conducted with suppliers who meet the requirements set in the request for proposals or procurement notice. This requirement is considered primary, and the contracting authority is obliged to include only those suppliers and bids that meet the authority's requirements in the final phase of the negotiation process. A valid reason for suspending the procurement procedure could be a situation where the supplier or suppliers and the contracting authority cannot find a solution that meets the authority's needs despite negotiations. If only one supplier remains in the final phase of the procurement process, who registered for the negotiation meeting and submitted a preliminary bid by the given deadlines, and that supplier cannot offer all the products specified in the preliminary request for proposals, it means that there are no suitable bids, and it would no longer be possible to ensure a genuine competitive situation or maintain a sufficient level of competition in the procurement process. Therefore, there is a valid and justified reason for suspending the procurement procedure POL-2024-125740 / Grenades and 40 mm Ammunition in accordance with Section 75 of the Public Procurement Act. The decision has been communicated to the parties involved on October 2, 2025.
