Open House Discount Contracts for Pharmaceuticals in Germany

The Techniker Krankenkasse (TK) is announcing all contract awards related to the ongoing "Open House Discount Contracts," "Open House Biologics Discount Contracts," and "Open House Originals Discount Contracts" that will begin on May 1, 2025. The TK aims to establish discount contracts with all suitable pharmaceutical companies. Please note that individual negotiations on contract terms will not be conducted; uniform conditions will apply. The TK does not guarantee exclusivity to any individual contracting partner. Participation in the Open House procedures is possible at any time during the contract duration. The non-exclusive discount contracts established through the TK's Open House procedures are primarily intended to bridge the period between the expiration of patents for active ingredients, combinations of active ingredients, or forms of administration, and the commencement of exclusive discount contracts. The TK reserves the right to replace the non-exclusive Open House discount contracts with exclusive discount contracts during the contract term, which will be established through a tender process subject to cartel procurement law. Upon the commencement of the exclusive discount contracts, the Open House discount contracts will end in accordance with the relevant legal and contractual regulations. Based on TK's experience, exclusive discount contracts typically come into effect eight to ten months after the publication of the corresponding tender announcement in the Supplement to the Official Journal of the European Union. Future contracting partners are encouraged to regularly check the Supplement to the Official Journal of the European Union for these tender announcements.
