    Brief

    This is a statutory service required under the Children and Families Act 2014 and SEND Code of Practice 2015. The service provides independent, impartial mediation and disagreement resolution to help resolve disputes between parents, young people (aged 0-25), and education providers, local authorities, or health commissioners regarding Education, Health and Care Plans. In Scope: • Delivery of independent mediation for children and young people aged 0-25 with statutory rights to mediation under SEND Code of Practice Chapter 11 • Provision of disagreement resolution for SEND-related issues outside statutory mediation (e.g., disputes with schools about SEN provision) • Delivery of legally required mediation information and advice to parents and young people before mediation requests • Production of quarterly monitoring reports with thematic analysis, trend identification, and key performance indicators Out of Scope: • Providing opinions or involvement in decision-making (facilitating discussions only) • Legal or tribunal advocacy • Casework, key-working, or ongoing support services • Disputes outside the Children and Families Act or SEND Code of Practice Suppliers must be independent service providers able to deliver impartial services and provide robust monitoring and reporting.
