Romania – National Road Maintenance Works – 4-Year Framework Agreement

This is a 4-year framework agreement for the execution of ongoing maintenance works, including the upkeep of bridges, passages, culverts, and tunnels. It also covers the maintenance of retaining walls and flood prevention measures. The contract is divided into several lots: Lot 1 - SDN Brașov, Lot 4 - SDN M. Ciuc, Lot 5 - SDN Sf. Gheorghe, and Lot 6 - S.A.S. According to Article 160, paragraph (1) of Law no. 98/2016, interested economic operators have the right to request clarifications or additional information regarding the award documentation up to 21 days before the deadline for submitting offers. The contracting authority will respond clearly and completely to all requests for clarification or additional information on the 11th day before the deadline for submitting offers. The contracting parties have the right to agree on modifications to the clauses during the execution of the framework agreement, including in cases where circumstances affect their legitimate commercial interests and could not have been foreseen at the time of concluding the subsequent contract, in accordance with Article 221, paragraph 1, letters a), e), and f) of Law no. 98/2016 on Public Procurement. Reasons for modifications may include changes in the quantities of works for an item in the subsequent contract, changes in the quantities and characteristics of an item in the subsequent contract, legislative changes or technical/normative standards, changes resulting from the abandonment of certain work items, and extension of the duration of the subsequent contract due to unforeseen elements. Modifications to the framework agreement will comply with Law 98/2016 and respect the situations provided in Article 221: less than 15% of the framework agreement price, and the duration of the subsequent contract may be extended by a maximum of 4 months due to adverse weather conditions.
