Non-Exclusive Discount Agreements for Beclometasone/Formoterol

This contract opportunity involves establishing non-exclusive discount agreements for the medication Beclometasone/Formoterol (ATC Code: R03AK08), excluding the dosage of 100µg/6µg as a metered-dose aerosol. The agreements will be made under an Open-House model, allowing all interested pharmaceutical companies to participate during the application period, provided they meet the participation requirements. Individual contract negotiations will not be conducted, and exclusivity is not guaranteed. The quantity of medication required is unknown and will depend on demand, the number of insured patients, prescribing behaviors of doctors, and the dispensing practices of public pharmacies. Minimum purchase quantities are not guaranteed. Interested pharmaceutical companies can download the participation documents from the German Procurement Portal (DTVP) after applying for access. Once access is granted, they can view the documents, which include the discount agreement and specified discounts, under strict confidentiality. Any sharing of these documents with third parties requires prior written consent from the contracting authority. If a company decides not to participate, all documents must be securely destroyed. Submission requirements are detailed in the documents "Cover Letter" and "Explanation of Contract Terms" available in the project room. Communication, including the submission of participation documents, will occur electronically via the DTVP portal. Any discrepancies in the contract notice are due to technical reasons and are not binding. Applications can be submitted until November 4, 2025, with further deadlines available in the "Submission Deadlines" document. If a deadline falls on a weekend or public holiday, the next business day will apply. Late submissions will be considered at the next deadline. The discount agreement will end by November 30, 2026, regardless of the contract date. The contracting authority reserves the right to terminate the Open-House process early, especially if exclusive discount agreements are established; in this case, existing agreements will end according to contractual terms. Based on past experiences, exclusive discount agreements typically take effect 8 to 12 months after the publication of the relevant contract notice in the EU Official Journal.
