Supply of Spare Parts for Mercedes and BMW Vehicles

This contract involves the supply of spare parts for Mercedes and BMW vehicles for the Transport Department of the Provincial Police Headquarters in Gdańsk. The contract is divided into two tasks: Task 1 involves the supply of spare parts for Mercedes vehicles, while Task 2 involves the supply of spare parts for BMW vehicles. The actual quantity of orders will depend on the real needs of the buyer. The specified quantity of spare parts is an estimate and may change during the execution of the contract according to the buyer's actual needs, but not exceeding the total contract value. Suppliers will not have any claims against the buyer for unutilized contract amounts. Orders will be fulfilled progressively based on the buyer's current needs, and unutilized contract amounts cannot be a basis for claims from the supplier. The supplied spare parts must be: 1) brand new and from the current catalog of the manufacturer or supplier, of good quality, with properties normally accepted in trade and suitable for their intended use, and possessing required certifications and homologations; 2) compliant with EU Regulation No. 461/2010 regarding the application of Article 101(3) of the Treaty on the Functioning of the European Union to categories of vertical agreements and practices in the motor vehicle sector; 3) marked with international homologation signs used in European homologation by the United Nations Economic Commission (ECE) - 'E' or the European Union 'e'; 4) marked with the manufacturer's identification for the vehicle for which the national type approval certificate was issued; 5) free from technical and legal defects, approved for trade, and of first quality; 6) packaged with the logo or trademark of the vehicle manufacturer. Deliveries will be made progressively, at the cost and risk of the supplier, based on orders placed by the buyer via phone, in writing, or by email. All requirements specified in the documents mentioned above are minimum requirements, and compliance is mandatory. Failure to meet these minimum requirements will result in the rejection of the offer as non-compliant with the terms of the contract.
