Food Supply Contract for Romania (2025-2027)

The contracting authority will establish framework agreements for a duration of 24 months with a maximum of 2 economic operators, without re-bidding. The framework agreements will be signed with the winning economic operators at the end of the awarding procedure. Subsequent contracts will be concluded without re-competition, with the highest-ranked bidder; if the first bidder does not uphold their bidding conditions or refuses to sign the subsequent contract, they must demonstrate the impossibility of fulfilling the contractual clauses. The contracting authority may then sign the contract with the next highest-ranked bidder who meets the bidding conditions. For the first 6 months after signing the framework agreement, price updates for contracts/framework agreements based on the inflation index provided by the National Institute of Statistics will not be accepted. Supply prices will NOT be updated with the inflation index for food products, EXCEPT before signing a new subsequent contract. If a subsequent contract is concluded after the first 6 months of the framework agreement's validity, and the highest-ranked economic operator requests a price update based on the inflation index, while the second-ranked operator has a lower price and does not request a price update, the subsequent contract will be signed with the second-ranked operator. Given the fluctuation in the number of incarcerated individuals for whom food products are purchased, subsequent contracts will be concluded based on the unit's needs and available budgetary funds. Interested economic operators can request clarifications on the awarding documentation until the 15th day before the deadline for submitting offers. The contracting authority will respond to clarification requests no later than the 10th day before the deadline for submitting offers.
