Brief
Comment: The contract aims to conclude a framework agreement as defined in Article 2, 35° of the law of June 17, 2016. It aims to create a list of expert offices that can be solicited by the contracting authority. The maximum number of bidders to be selected is three. The purpose of this contract is to designate approved experts in contaminated soil management for the execution of missions provided for by the decree of March 1, 2018, related to the management and remediation of soils and the missions provided for by its implementing orders. The missions will include conducting orientation studies (including preliminary studies), characterization studies (including risk studies), remediation projects, monitoring of remediation acts and works on the ground, and conducting final evaluations, as well as establishing quality reports of land (RQT). Bidders may also be solicited for drafting interpretation notes of analysis results for internal use. These studies will be conducted on behalf of SPI and/or its subsidiary SORASI. They may also be conducted on behalf of municipalities/institutions under the "Local Authorities" sector of SPI for which SPI would have a delegated project management mission. The purpose of this contract is to carry out a series of investigations to provide the Contracting Authority with all the useful information for an appropriate understanding of the contamination status of lands (or elements justifying the absence of contamination), as well as to inform it of any measures to be taken for the environmental rehabilitation of the site in connection with the realization of the planned projects. If necessary, the selected approved expert must integrate existing results (ISSeP studies or other previously conducted studies) into their studies, as far as possible. The studies covered by this contract must be able to fit within the framework of the decree of 01/03/2018 and must be carried out in compliance with the Walloon Code of Good Practices (CWBP) and the Walloon Compendium of Sampling and Analysis Methods (CWEA). In case of a request for additional information by the Administration (Soil Remediation Directorate - DAS) following the submission of a study under the decree of 01/03/2018, in order to achieve a study compliant with the CWBP, no additional fees may be requested. In case of legislative changes before the end of the contract, the bidder will be required to comply with the Administration's directives regarding whether the mission can continue under the old regime or must comply with the new legislation. If significant modifications due to legislative changes are required by the Administration, the terms for continuing the mission will be agreed upon between the bidder and the Contracting Authority. The Contracting Authority will select the three bidders with the three highest final scores according to the method determined in point I.10 Award Criteria. For each new file, the contracting authority will assign missions to the participants in the framework agreement, without re-competition, in order of ranking and ensuring a balanced distribution of missions among them. The conclusion of this contract does not grant the provider any exclusivity rights. SPI may, even during the validity period of the contract, have identical or similar services executed by other providers. In this case, the contractor cannot claim damages.
