Legal Consulting Services for Cultural Institutions in France

This contract involves providing legal consulting services related to the management and operation of non-profit organizations in the cultural sector. The framework agreement will cover advisory services on institutional management and operations in the cultural field, particularly in the following situations: - Management and operation of private organizations (associations, endowment funds, etc.) involved in the cultural sector (functioning of bodies and organs, issues related to statutes or founding agreements, financing, human resources, etc.); - Management and operation of public organizations (public cultural cooperation establishments, public interest groups, mixed syndicates, etc.) involved in the cultural sector (functioning of bodies and organs, issues related to statutes or founding agreements, financing, human resources, etc.); - Legal advice, especially in pre-litigation matters and assistance in contract procurement; - Assistance in amicable dispute resolution, including mediation and participation in interregional advisory committees for amicable dispute resolution; - Participation in meetings organized by departmental services. The main tasks will include: - Providing advice on association law and institutional public law, requiring expertise in the functioning and management of non-profit organizations in the cultural sector; - Supporting institutional management, which involves decision-making assistance through the production of legal notes to assess legal, financial, social, and criminal risks associated with the functioning and management of organizations in the cultural sector; - Analyzing and drafting complex contractual arrangements concerning non-profit organizations in the cultural sector; - Drafting legal documents related to the functioning and management of non-profit organizations in the cultural sector, including amendments to statutes, preparation of resolutions for deliberative bodies, and carrying out legal publicity formalities. The services covered by this contract are reserved for the specific profession of lawyers, in accordance with the provisions of Law No. 71-1130 of December 31, 1971, which reformed certain judicial and legal professions.
